What Is Kidnapping?
Colorado defines the crime of first-degree kidnapping under CRS 18-3-301 as committing any of the following acts with the intent to force the victim or another to give up anything of value:
- Forcibly seizes or carries another person from one place to another
- Entices or persuades another person to go from one place to another
- Imprisons or forcibly secretes another person
This crime is classified as a class 2 felony if the alleged victim is unharmed. This offense carries penalties of 8 to 24 years in prison and a fine up to $1,000,000. If the alleged victim suffers bodily injury, it is considered a class 1 felony. Class 1 felonies are the most serious felonies in Colorado and can result in life imprisonment.
Possible Defenses To Kidnapping Charges
A highly experienced criminal defense attorney can listen to your story and build a defense based on the specifics of your case. Some common defenses to these types of charges include:
- Mistaken identity
- Mistake of fact or law
- Alibi
- Misunderstanding
- Insanity or impaired mental state
- Consent
- Lack of intent
We will also argue that the prosecution has failed to meet its burden of proof.
